Definitions
“Website” refers to likizolettings.co.ke – across desktop, mobile and tablet. “We / our / us” refers Likizo Lettings Limited; Owner/Host refers to any person or entity that lists property and “Renter/Traveler” refer to the user visiting our website to book a listing.
Terms of Use
By registering on this website as a Host or Owner, you agree to provide us with accurate and updated information about yourself and you agree to provide us with proof of your identity and ownership of the properties being listed on this website upon request. You accept that you own all lawful rights to the photos, descriptions and contents that you post on the Listings. And such content is correct and not misleading in any way. And the use of such contents will not violate any this Agreement or any right of any person or entity.
We reserve the right, in our sole discretion, to refuse to publish, suspend or even permanently remove any listing(s) based on content and accuracy of such listing(s) or for any reasons known.
By registering as a Renter or Traveler, you agree to be subjected to any identity verification requested by us or the Owner prior and/or after booking confirmation. Upon receiving booking confirmation from us, you enter a legal rental agreement directly with the owner. You agree to have read and understood the cancellation policy chosen by the Owner. You agree to make all communication prior booking confirmation via the Likizo Lettings internal messaging platform. You agree that you will not make any scam-booking (booking to throw a party for underage or for illegal activities) on the website.
This Agreement supersedes all prior understandings, agreements or representations and you may not rely on any representations or warranties about the subject matter of this Agreement except as expressly provided in this Agreement.
Terms
- The website is an online platform for connecting the vacation renter owners with the renters. We do not represent, manage nor own any of the vacation rentals listed on the website. And we are not a party to any rental agreement between users of the website.
- We try our best to confirm the identity of the users on our website but user verification on the internet is difficult and we cannot assume any responsibility for confirmation of the purported identity.
- You agree to keep your personal information like user ID and password confidential. If we suspect any unauthorized access to your account, upon your request, you agree to promptly change your password and take any other precautions we as we may request.
- You acknowledge and agree we will have no liability for any unauthorized transaction made using your account.
- You agree that all communications between users of this website shall be done through the internal messaging system of the site.
- We do not tolerate spam or the share of unsolicited commercial communication whatsoever. You agree that you may not use any service of this website to send spam or unsolicited commercial messages.
- You agree that all payments for the services rendered on this website shall be done through the secure payment platforms of this website. You will not solicit for payment to be made outside of the Likizo Lettings website. This does not include the security deposits requested by host upon check-in.
- We charge a service fee to Owners and/Renters (collectively referred to as “Service fees”) for the use of our services. Any applicable service fee payable by renters who book a property on this website will be displayed at the time of booking. This service fee covers the use of the website, including such features as 24/7 user support, and is calculated as a variable percentage of the total reservation amount (which may or may not include additional fees, taxes and damage deposits). This service fee will only be refunded in the event that the owner uses the flexible cancellation policy and accepts the cancellation of the renter’s reservation.
- The service fee charged to renters is set at 5% (unless otherwise stated) of the total booking amount and it is payable during checkout.
- The service fee charged to owner is set at 5% for owners with less than five (5) listings and 3.5% to owners with more than five (5) listings.
Cancellation Policy
There are three cancellation policies available for hosts to choose from, namely: Flexible, Moderate, and Strict.
Flexible: Cancellations made within 72 hours in advance of the check-in date will receive full refund.
Moderate: Cancellations made within 72 hours will receive a 50% refund.
Strict: Cancellations made within 72 hours will not receive a refund.
Payout Terms
You agree that the payout for each booking will be released to your designated account, less our service fee, about 48 hours after check-in date. The time it takes for the funds to arrive in your account depends on your payout method. If your guest is staying for 28 or more nights, payouts for that reservation are released 15 days after check-in.
Disputes Resolution
We are committed to customer satisfaction, so if you have a problem or dispute, we will try to resolve your concerns amicably. If the dispute arises as a result of damages or default between users, you agree to try to solve it diplomatically but if that fails, you can pursue legal actions according to the law of your jurisdiction. Keep us informed but you accept that Likizo Lettings will not be held liable for any cost(s) incurred.
Your acknowledgements
You acknowledge that at all times during the Term of this Agreement
(a) You have read and agree to be bound by the terms of our Privacy Policy and Website Terms of Use applicable to you, as amended from time to time (we will notify you of all amendments that are of a non-trivial nature);
(b) In consideration for your right to upload listings to the website and the other services we provide, you grant us an irrevocable, perpetual, world-wide, royalty free license to publish, copy, license to other persons, use and adapt for any purpose related to our websites any content you provide to us during the Term, and this license survives termination of this Agreement by you or us;
(c) We may take any action we deem appropriate in relation to your listings if we consider there has been a breach of this Agreement, including removing listings from the website;
(d) You are solely responsible for the content of your listings and any errors or omissions in your listings – our role is one of publisher;
(e) If we change this Agreement in any non-trivial way, we will notify you of such changes;
(f) The terms and conditions applicable to your listing and any other products at any point in time are the relevant terms and conditions published at https://likizolettings.co.ke/terms-and-conditions/ at that point in time (i.e. as amended in accordance with the provisions above);
(g) We cannot guarantee the continuous or fault-free operation of the website or other services we provide you and, without limitation, systems or technological failure or delay may impede or prevent access to the website and other services.
